1. Acceptance of Terms
By accessing or using Ghana SME Hub ("the Platform"), you agree to be bound by these Terms of Service. These terms are governed by the laws of the Republic of Ghana, including the Electronic Transactions Act, 2008 (Act 772) and the Contract Act, 1960 (Act 25).
2. Description of Services
Ghana SME Hub is a marketplace platform connecting small and medium enterprises (SMEs) with verified service providers across various business categories including company registration, accounting, HR, technology, and more.
3. User Accounts
You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Be responsible for all activities under your account
4. Payment Terms
4.1 Payment Processing
All payments are processed securely through our authorized payment partners. Prices are displayed in Ghana Cedis (GH₵) and include applicable taxes where indicated.
4.2 Non-Refundable Policy
IMPORTANT: All payments made through Ghana SME Hub are final and non-refundable. By completing a payment, you acknowledge and agree that:
- Service fees paid are non-refundable once payment is confirmed
- No refunds will be issued for completed or partially completed services
- No refunds will be issued for change of mind or business circumstances
- In cases of service provider failure, resolution will be through service completion by an alternative provider, not monetary refund
- Any disputes regarding services must be raised within 7 days of service delivery
4.3 Chargebacks
Initiating a chargeback or payment dispute without first attempting resolution through our support channels may result in account suspension and legal action to recover funds and associated costs.
5. Service Delivery
Service timelines are estimates and may vary depending on the nature of the service and requirements from third parties such as government agencies. Ghana SME Hub facilitates service delivery but is not directly responsible for delays caused by external entities.
6. User Responsibilities
Users must:
- Provide accurate information required for service delivery
- Respond promptly to requests for additional information
- Comply with all applicable Ghanaian laws and regulations
- Not use the platform for fraudulent or illegal purposes
7. Intellectual Property
All content, trademarks, and intellectual property on the Platform are owned by Ghana SME Hub or its licensors. Users may not reproduce, distribute, or create derivative works without written permission.
8. Limitation of Liability
To the maximum extent permitted by Ghanaian law, Ghana SME Hub shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Actions or omissions of third-party service providers
- Service interruptions or platform unavailability
Our total liability shall not exceed the amount paid by you for the specific service in question.
9. Dispute Resolution
Any disputes arising from these Terms shall be resolved through:
- Good faith negotiation between parties
- Mediation through an agreed mediator in Accra, Ghana
- If unresolved, arbitration in accordance with the Alternative Dispute Resolution Act, 2010 (Act 798)
The courts of Ghana shall have exclusive jurisdiction over any matters not resolved through arbitration.
10. Termination
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or for any other reason at our discretion. Outstanding service requests will be handled on a case-by-case basis.
11. Modifications
We may modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the modified Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Ghana.
